The Access to Health Records Act 1990 provides certain individuals the right to view health records related to a deceased patient, including hospital documentation. This access pertains specifically to records created on or after 1st November 1991.
Access is granted to:
- The patient’s personal representative (typically the executor of the will or administrator of the estate)
- Any individual who may have a claim arising from the patient’s death
